Welcome to KAVEX AIR. The terms “we,” “us,” and “our” refer to KAVEX AIR, operated by KAPA COMPRESSOR CORP. KAVEX AIR operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when using our website or purchasing our products.
By visiting, accessing, interacting with, or purchasing from our website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not use our Services.
SECTION 1 – ACCESS AND ACCOUNT
By using our Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
When placing an order or creating an account, you agree to provide accurate, current, and complete information, including your contact, billing, payment, and shipping information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
KAVEX AIR sells air compressors, compressed-air equipment, dryers, tanks, filters, accessories, parts, and related industrial products.
We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, performance data, pressure ratings, airflow ratings, horsepower ratings, voltage information, and other information displayed on our website are accurate.
However, manufacturers may update product specifications, components, designs, or appearance from time to time. Minor differences that do not materially affect the intended function or performance of the product may occur.
Customers are responsible for confirming that the selected product is suitable for their intended application, including required voltage, phase, horsepower, pressure, airflow (CFM), electrical requirements, environmental conditions, and installation requirements.
If you are unsure which product is appropriate for your application, please contact KAVEX AIR before placing your order.
We reserve the right to modify or discontinue products or specifications without prior notice.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase products from KAVEX AIR. We reserve the right to accept, decline, cancel, or request additional verification for an order when reasonably necessary.
An order is not considered finally accepted until payment has been authorized or otherwise arranged and KAVEX AIR confirms the order.
Customers are responsible for reviewing all order information before submitting an order, particularly model, horsepower, voltage, phase, pressure, quantity, accessories, and shipping information.
Orders may be placed by individual consumers, businesses, contractors, distributors, resellers, manufacturers, and other commercial customers.
Purchases for resale may be subject to applicable resale certificate and tax documentation requirements.
Customized, special-order, special-voltage, or specially configured products may not be cancelable after production, modification, or order processing has begun.
Returns and refunds are governed by our separate Return & Refund Policy.
SECTION 4 – PRICES, PAYMENT AND TAXES
Prices, promotions, discounts, and product availability may change without notice.
Unless otherwise stated, product prices do not include applicable sales tax, freight, shipping, handling, installation, customs duties, import charges, or other applicable fees.
The final amount payable will be displayed during checkout or provided in a formal quotation.
For certain industrial equipment or commercial orders, pricing displayed online may differ from pricing provided through negotiated quotations, distributor agreements, volume purchases, or customized equipment proposals.
You agree to provide complete and accurate billing and payment information and represent that you are authorized to use the payment method provided.
Applicable sales taxes will be collected where required by law.
SECTION 5 – SHIPPING, FREIGHT AND DELIVERY
Delivery dates and transit times are estimates and are not guaranteed.
Industrial equipment may be shipped by parcel carrier, LTL freight, truck freight, or other commercial transportation services.
Unless expressly stated otherwise in writing, the customer is responsible for ensuring that the delivery location can safely receive the equipment.
Depending on the shipment, the customer may need to provide a loading dock, forklift, pallet jack, liftgate service, or other appropriate unloading equipment.
Standard freight delivery generally does not include moving equipment inside a building, installation, rigging, electrical connection, or placement at the final operating location unless specifically agreed to in writing.
Customers should inspect shipments upon delivery. Visible damage should be noted on the carrier’s delivery receipt before signing whenever reasonably possible.
If equipment arrives damaged or incomplete, please contact KAVEX AIR promptly and retain the packaging, photographs, delivery documents, and other relevant evidence.
We are not responsible for delays caused by carriers, weather, customs, government actions, natural disasters, labor disruptions, or other circumstances outside our reasonable control.
SECTION 6 – INSTALLATION AND OPERATION
Air compressors and related industrial equipment must be installed and operated in accordance with applicable product manuals, electrical codes, safety requirements, and manufacturer instructions.
The customer is responsible for confirming that the installation site has the correct electrical supply, voltage, phase, wiring, circuit protection, ventilation, foundation, piping, drainage, and other required infrastructure.
Electrical installation and other work requiring professional qualifications should be performed by appropriately licensed or qualified personnel.
Damage resulting from incorrect voltage, improper electrical connection, improper installation, misuse, inadequate maintenance, unauthorized modification, or operation outside the product’s specified conditions may not be covered by warranty.
SECTION 7 – RETURNS AND REFUNDS
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy.
Standard-stock products that qualify for return may generally be returned within the period specified in that policy, subject to applicable conditions.
Installed, energized, operated, customized, special-order, or specially configured industrial equipment may not qualify for ordinary returns.
Customers must obtain return authorization from KAVEX AIR before returning equipment.
SECTION 8 – WARRANTY AND TECHNICAL SUPPORT
Products may be covered by a manufacturer or KAVEX AIR limited warranty as specified in the applicable product documentation, quotation, invoice, warranty statement, or product listing.
Warranty coverage does not generally include normal wear, consumable items, improper installation, misuse, unauthorized modification, inadequate maintenance, incorrect electrical supply, external damage, or operation outside specified conditions.
Warranty claims may require photographs, videos, serial numbers, operating information, maintenance records, or other information reasonably necessary to diagnose the issue.
Warranty service may include technical assistance, repair, replacement parts, component replacement, or other remedies depending on the circumstances and applicable warranty.
SECTION 9 – INTELLECTUAL PROPERTY
The content of this website, including trademarks, logos, product information, text, graphics, photographs, videos, designs, and other materials, is owned by or licensed to KAVEX AIR, KAPA COMPRESSOR CORP, or their respective licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use our protected content without prior written authorization, except as permitted by law.

SECTION 11 – RELATIONSHIP WITH SHOPIFY
KAVEX AIR is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and KAVEX AIR. Shopify is not the seller of the products purchased from KAVEX AIR and is not responsible for the products, installation, delivery, warranty, or other aspects of the transaction between you and KAVEX AIR.
SECTION 12 – PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable law.
Because our store is hosted by Shopify, certain information may also be processed by Shopify and other service providers necessary to operate our online store, process payments, fulfill orders, analyze website activity, and provide related services.
SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product specifications, pricing, availability, shipping charges, transit times, promotions, or other information.

If a material pricing or product information error affects an order, we may contact you to confirm the corrected information or cancel and refund the affected order.

These Terms of Service are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to applicable law, disputes relating to these Terms or transactions with KAVEX AIR will be handled in the appropriate courts located in Texas.
